Most of Town Board backs off challenging legality of tower By John J. Hopkins Times
They still don't like the fact that a state agency has built a 250-foot tall communications tower in the Bellevue neighborhood, but most members of the Town Board have decided that pursuing legal action over the issue is not worth the time and money. Located off Indian Road near Broadway, the tower, which will become part of New York's State Wireless Network, or SWN, is visible from miles around. It is the tallest structure in Cheektowaga.
Bellevue residents, particularly those who live near the tower, were dismayed by the board's decision. Many say that the tower is obtrusive, and one Fawn Court resident said that a strobe light atop the structure causes distractions inside his home.
"I had to rearrange my living room furniture," to avoid the flashing light, said David Wiercioch, who provided the board with pictures of the tower, located just three-tenths of a mile from his home. "What (benefit) am I going to get out of this?"
The SWN is a $2 billion project of the state's Office for Technology (OFT). Building the network is Massachusetts-based M/A Com. The private company is using a technology it owns called "Open Sky" to build the system.
